EcoToken Terms of Service

You must be at least 18 years old (or the age of majority in your jurisdiction, whichever is higher) to create a paid Account or purchase Credits. By registering you represent and warrant that (a) all information you provide is accurate and current, (b) you have the authority to bind yourself (or the entity on whose behalf you act) to these Terms, and (c) your use of the Service will not violate any applicable law.

You are responsible for maintaining the confidentiality of your Account credentials and for all activity that occurs under your Account. Notify us promptly at ecotoken.support@pfpendeavors.com if you suspect unauthorized access.

Paid plans are billed in advance on a monthly or annual cadence. Credits are billed in a single up-front charge. All amounts are in U.S. Dollars unless otherwise stated and exclude taxes, which you are responsible for where applicable. Payment is processed by Stripe, Inc.; we do not receive or store your full payment-card details.

Subscriptions renew for successive periods equal to your original term unless you cancel before the end of the current period. You may cancel at any time from your billing portal; cancellation takes effect at the end of the current billing period unless we state otherwise.

Paid periods that have already begun are non-refundable except where required by law or expressly granted by us in writing. Pay As You Go Credits are non-refundable but do not expire.

We may change prices with at least 30 days' notice, effective on your next renewal. Continued use after the effective date constitutes acceptance.

The BYO plan requires you to supply a valid Anthropic API key. AI calls on the BYO plan are billed directly by Anthropic to you, at rates set by Anthropic. EcoToken charges only the monthly subscription fee; we are not responsible for Anthropic's charges.

You retain all rights in your User Content. By submitting User Content to the Service, you grant us a worldwide, non-exclusive, royalty-free license to process, store, transmit, and display that content solely as necessary to operate and improve the Service for you. This license terminates when you delete the relevant content or your Account, except to the extent residual copies remain in routine backups for a limited retention period as described in our Privacy Policy.

We do not use your User Content to train third-party models and do not provide it to third parties except as strictly required to fulfill an optimization request you initiated (currently, transmission to Anthropic's API). We do not sell your User Content.

You represent and warrant that you own or have all necessary rights to the User Content you submit and that it does not violate any third-party rights, applicable law, or the usage policies of downstream AI providers.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL THE COMPANY BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST REVENUE, LOST DATA, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY.

OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY AND ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (a) THE AMOUNTS YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM OR (b) USD $100. Some jurisdictions do not allow the limitation or exclusion of certain damages, so the above may not fully apply to you.

You may terminate your Account at any time by using the "Delete account" action inside the Service (under Settings → Danger zone). Upon deletion:

• We will cancel any active Subscription effective immediately;
• We will permanently erase your User Content, savings records, projects, calibration samples, and BYO key from our primary systems;
• Residual copies may remain in routine backups for up to 30 days before being overwritten;
• Stripe invoice records are retained per Stripe's own compliance rules and are outside our control.

We may suspend or terminate your Account at our reasonable discretion for (a) violation of these Terms, (b) suspected fraud or abuse, (c) non-payment, or (d) where required by law.

Sections that by their nature should survive termination — including Sections 5.2, 6, 10, 11, 12, 15, 16, and 17 — shall survive.

These Terms are governed by the laws of the State of Utah, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in Utah, and the parties irrevocably consent to the personal jurisdiction and venue of those courts.

Before filing any claim, you agree to contact us at ecotoken.support@pfpendeavors.com and make a good-faith attempt to resolve the dispute for at least 30 days.

These Terms (together with the Privacy Policy and any order form) constitute the entire agreement between you and the Company regarding the Service and supersede all prior or contemporaneous communications.

If any provision is held unenforceable, the remaining provisions will remain in full force.

Our failure to enforce any right or provision is not a waiver.

You may not assign these Terms without our prior written consent. We may assign them in connection with a merger, acquisition, or sale of assets.

We are not liable for failures caused by events outside our reasonable control, including acts of God, labor disputes, internet outages, or government action.
